LIVE IN RELATIONSHIP--------------SAT PAL







There has been 60 percent increase in number of live- in relationship cases in India since 2004. The trend, no doubt, indicates a significant shift in our social behavior as well as institution of marriage in the country despite the long-standing belief that marriages are arranged in heaven though solemnized on earth.



Recently the Hon’ble Supreme Court opined that two persons living together without marriage couldn’t be construed as an offence. Further no law prohibits live- in relationship and pre martial sex. Article 21 of the Indian Constitution provides a right to life and liberty as a Fundamental Right. It has become clear that two adults may be male or female or male and female can have a live- in relationship in case they have similar likings, vibes, wavelength and an outlook towards life. It is a matter of liking per se and no body can deny them of their right to life as guaranteed by the Constitution. It may be noted that the Courts have been becoming liberal as far as interpretation of law is considered. The ruling of Hon’ble High Court of Delhi in respect of section 377 IPC could be understood in the changing attitude and personal commitments. The youth is not at all bound to accede to the diktat of their families as they have adopted a new life style and proved their non-dependence on their elders. They want to live as per their liking. Moreover this sort of live- in relationship is like an unwritten agreement which cant be a matter of any dispute as they can live together as long as they feel comfortable with each other. In today’s world all those single can mingle and get to know each other’s compatibility. They can freely decide their terms and conditions mutually. They can even break up at their convenience. The live in relationship is like any political alliance that takes place without any thing in black white and exists till both parties continue to feel that another party is not overlooking their interests. The breakup in live- in relationship results in no encumbrances and liabilities after the break though the National Commission for Women has been stressing upon the need of change in the definition of wife as defined in section 125 IPC which deals with maintenance. The commission has also been demanding inclusion of women involved in a live-in relationship in above stated definition. Apart from this the long-term relationships are being stated to be valid to claim alimony.



There are a few social network sites to facilitate selection of a partner for a live-in relationship. In some cases the partners under a live-in relationship are left with no choice but to conceal their relation to find a house or an apartment on rent. In some cases it has been observed that such a relationship is taken as a test to decide compatibility and go for a marriage in case every thing goes well. Eyebrows are also being raised on the aspect of an adverse effect on morality due to live-in relationship. It is also being stated that such relationships were in existence in the past as in mythological reference a live in relationship between Radha and Krishna is being taken in high esteem by the devotees till today. Anyhow, the increase in the cases of live in relationship will bring down number of cases related to the family law as more and more persons will mutually opt for such relationship and decide to breakup without knocking at the doors of the judiciary. Let us watch this social change and wait to analyze the pros and cons of this new trend. Aamin!
